In New York State, if you decide to have someone assess and remediate an area with more than 10 square feet of mold, the Department of Labor (DOL) requires you to hire a licensed Mold Assessor to first perform an inspection and then a licensed Mold Remediation Contractor to perform the cleanup work.

Mold Violations

Per Local Law 55 of 2018, owners of residential buildings in New York City with 3 or more dwelling units are responsible for keeping their tenants’ apartments mold free from mold and fixing conditions that lead to mold. When mold conditions are identified in a building with 3 or more dwellings, the Department of Housing Preservation and Development (HPD) may issue a mold violation to the property owner. Depending on the size of the building and the type of violation, owners may be required to use both a licensed Mold Assessor and a licensed Mold Remediator in order to correct and certify the violation.
